Terms of Use
These Terms of Use ("Terms") govern your use of SayLuma. By creating an account or using the service, you agree to these Terms and the Privacy Policy.
1. Eligibility
You must be at least 13 years old to create a SayLuma account. If you are under the age of legal majority where you live, you should use SayLuma only with the permission and supervision required by your parent or legal guardian. By creating an account, you confirm that you meet this age requirement and agree to these Terms and the Privacy Policy.
2. What SayLuma provides
SayLuma provides AI-assisted English-language practice, including text conversation, speech transcription, generated tutor voices, vocabulary suggestions, progress tracking, and educational feedback. SayLuma's tutors, portraits, and voices are artificial-intelligence features and are not real people.
3. Educational service; AI limitations
SayLuma is a learning and practice tool, not a human teacher, accredited school, testing authority, employer, lawyer, medical provider, financial adviser, immigration adviser, or emergency service. AI systems can make mistakes, misunderstand speech, produce inaccurate translations, or give incomplete information. You are responsible for evaluating information before relying on it for important decisions.
4. Your account
You are responsible for providing accurate account information, keeping your password and devices secure, and notifying us if you believe your account has been compromised. You may not share an account in a way that circumvents usage limits or security controls.
5. Your content
You retain your rights in the text, speech, and other content you submit. You give SayLuma a limited, non-exclusive right to process that content only as reasonably necessary to operate, secure, improve, and support the service. This includes sending relevant content to service providers such as OpenAI, Supabase, Vercel, and Resend as described in the Privacy Policy. To the extent permitted by law and applicable provider terms, you may use AI-generated output you receive, but you are responsible for how you use it.
6. Acceptable use
You may not use SayLuma to violate law or the rights of others; harass, exploit, or harm people; distribute malware; attempt unauthorized access; interfere with the service; bypass authentication, rate limits, quotas, or billing controls; use automated systems to consume the service at abusive scale; or reverse engineer security mechanisms except where applicable law expressly permits it. We may limit or suspend access to protect users, our systems, service providers, or the public.
7. Privacy
Our Privacy Policy explains how information is handled. Please avoid entering highly sensitive personal information into AI conversations unless it is genuinely necessary for your learning purpose.
8. Subscriptions, trials, cancellation, refunds, and usage allowances
Subscriptions and Billing. SayLuma's Android subscription is purchased and billed through Google Play. The price, billing period, trial or promotional offer (if any), and other purchase terms displayed by Google Play when you subscribe apply to that transaction. The current U.S. list price is $4.99 per month, subject to the price and purchase terms displayed by Google Play. Subscriptions automatically renew unless canceled before the next renewal.
Free Trials. Google Play may offer eligible new subscribers a 7-day free trial. Trial eligibility is determined through the applicable Google Play offer and may depend on factors such as account eligibility, territory, or prior subscription history. If you accept a free trial and do not cancel before the trial ends, the paid subscription begins automatically and Google Play charges the subscription price presented when you accepted the offer. If no free trial is offered to your account, the subscription begins according to the terms Google Play displays before you confirm the purchase.
Managing or Canceling Your Subscription. You can manage or cancel your Google Play subscription using the Manage subscription control in SayLuma or through your Google Play subscription settings. Canceling a subscription stops future renewal but does not ordinarily end an already-paid access period immediately. Your SayLuma access remains governed by the subscription status and access period verified through the billing system.
Refunds. Canceling a subscription does not by itself issue a refund. Refund eligibility and processing for purchases made through Google Play are governed by Google Play's applicable refund policies and applicable law. Where available, refund requests for Google Play purchases may be submitted through Google Play.
Usage Allowances. A SayLuma subscription is subject to the usage allowances associated with the subscriber's plan. The current monthly plan includes up to 240 voice minutes and 1,000 tutor replies during the applicable usage period. Access to AI features may be limited when an allowance has been exhausted until the applicable allowance period resets.
9. Account deletion and termination
You may permanently delete your SayLuma account and associated learning data through the Profile screen. If you cannot access the app, you may request deletion through our public Delete Account page. Deletion cannot be undone. We may suspend or terminate access when reasonably necessary for security, abuse prevention, violation of these Terms, legal requirements, or discontinuation of the service.
10. SayLuma intellectual property
SayLuma's software, branding, interface, tutor designs, logos, and other service materials are owned by or licensed to SayLuma and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of the SayLuma service or brand to you.
11. Service changes and availability
Features may change, be interrupted, or be discontinued. We do not promise that the service will always be available, error-free, compatible with every device, or that any particular AI model, voice, tutor feature, or price will remain available.
12. Disclaimer of warranties
To the maximum extent permitted by law, SayLuma is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, SayLuma and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunities, or goodwill arising from use of the service. Where liability cannot be excluded, it will be limited to the amount you paid to SayLuma for the service during the 12 months before the event giving rise to the claim, or US $25 if you paid nothing, unless applicable law requires a different result.
14. Governing law
These Terms are governed by the laws of the State of Maine and applicable United States federal law, without regard to conflict-of-law rules. Mandatory consumer protections in your country or state remain unaffected where they cannot legally be waived.
15. Changes to these Terms
We may update these Terms as SayLuma develops. If a change is material, we will update the effective date and may provide additional notice. Continuing to use SayLuma after updated Terms take effect means you accept them, to the extent permitted by law.
